School Teachers' Review Body

The School Teachers’ Review Body (STRB) was established in September 1991 under the School Teachers’ Pay and Conditions Act 1991. The legal foundation for the function and work of the STRB is now in Part Eight and Schedule Eleven of the Education Act 2002 (the Act). The Act stipulates the function of STRB and the main processes it must follow in its work.
The function of STRB is to consider matters referred to it by the Secretary of State for the Department for Education (DfE) in relation to the remuneration, professional duties or working time of school teachers in England and Wales. The Secretary of State can refer matters to STRB at any time. STRB reports to the Prime Minister and the Secretary of State for Education.
The Education Act 2002 gives the Secretary of State power to determine the remuneration of school teachers and other conditions of employment of school teachers which relate to their professional duties or working time. It also provides that the Secretary of State can only make such determinations after he has first referred the matter to the STRB and considered its report.
Before reporting on a matter referred to it, STRB is required to provide certain stakeholders and the Secretary of State an opportunity to submit evidence and make representations, as it deems appropriate. Stakeholders are representatives from local authorities, associations of local authorities, bodies representing school governors and bodies representing teachers.
The requirement for the Secretary of State to refer matters on teachers’ remuneration and conditions of employment to STRB can be set aside under two circumstances described in the Act:
• if the Secretary of State decides that a matter is ‘subsidiary’ (provided the matter meets certain criteria set out in section 125(3) of the Act), or;
• if the Secretary of State consults the STRB Chair about disapplying the requirement.
Before making an order setting out the remuneration or conditions of employment, the Secretary of State must consult stakeholders.
